USCIS FEE INCREASES ON HOLD, TEMPORARILY

A federal judge in the Northern District of California issued an order that temporarily prohibits USCIS from implementing fee increases that were to go into effect on October 2. The judge found that the plaintiffs were likely to prove that the Acting Secretaries of Homeland Security and USCIS did not have the lawful authority to issue the rule to raise fees, and that the rule failed to meet data requirements under the Administrative Procedures Act. It is difficult to predict how long this order will remain in effect.
